Product Purchasing, Membership Terms & Conditions of Service
Please read these terms and conditions carefully. You must agree to them
in order to become a member or purchase a product.

  1. By joining or purchasing Health and Fitness service (hereafter referred to as the "Service") you agree to be bound by this agreement (the "Agreement"). The Agreement is subject to change by Health and Fitness at any time; changes effective to each member or purchaser upon notification.

  2. The following fees and charges may be applicable to the purchaser:

    Membership Fees: The member is responsible for regular membership fees according to the billing terms in effect at the time.

  3. Until and unless this Agreement is canceled in accordance with the terms described herein, the Purchaser authorizes the Service to continue to charge the Purchaser's credit card (or other approved method) to continue the membership. The Service is also authorized to charge the Purchaser's credit card (or other approved method) for any and all purchases of products, services, and/or entertainment provided by Health and Fitness. Membership is non-transferable. Purchasers must inform Health and Fitness immediately of any of the following: 1) changes, revocation, or expiration of any credit card used with the Service; 2) changes in billing address; 3) any possible security breaches or unauthorized disclosure or use of an ID or password. Until and unless Health and Fitness is notified of such a breach, by electronic, conventional mail, or telephone (310-372-0965), Purchaser remains liable for any access.

  4. Payment may be arranged by automatic credit card charge. Upon expiration, subscribers will be renewed automatically for the term of the original membership, unless Health and Fitness is notified otherwise within 3 days prior to membership expiration.

  5. This agreement may be terminated at any time, without cause, by either party by notification to the other party by conventional or electronic mail, or by telephone. Purchasers remain liable until official termination.

  6. It is the sole responsibility of the individual purchaser to remember his/her password and to keep it confidential. The Service will not release passwords for any reason, unless specifically required by law or court order.

  7. In any failure of performance, error, interruption, deletion, delay in operation or transmition, theft of or unauthorized access to, or alteration of, records, regardless of cause, the Service strictly limits its liability to the amount paid by or on behalf of the Purchaser to the Service within the last ninety (90) days. In states which do not allow this exclusion or limitation of liability, the above may not apply.

  8. Health and Fitness makes no warranty regarding any information, services, or products, unless explicitly stated, provided or offered through the Service. Health and Fitness hereby expressly disclaims any and all warranties, express or implied, including, without limitation: a) warranties as to the availability, accuracy, or content of information, products, and/or services; b) warranties of merchantibility or fitness of any particular product for any particular use or purpose. In states which do not allow this exclusion or limitation of liability, the above may not apply.

  9. Purchasers agree not to use the Service in any way to submit, publish, display or advertise any defamatory, inaccurate, abusive, threatening, racially offensive or illegal material. Transmition of any such material is prohibited and is a breach of Agreement.

  10. Purchasers are forbidden to engage in any advertising or solicitiation through the Service without first obtaining the written consent of the Service. Purchasers are wholly responsible for any and all informaiton they send or display through the Service, even should a dispute arise after termination of service.

  11. The Service does not provide facilities for sending or receiving confidential information. Any and all electronic messages entered into the Service can and may be read by the operators of the Service.

  14. The Purchaser warrants and represents that he or she is 18 years of age or older, and is fully competent and qualified to enter into this agreement.

  15. This document represents the entire agreement between the Purchaser and Health and Fitness, and supercedes and replaces any and all previous agreements, whether implied or explicit. It may only be amended upon notice given by Health and Fitness to Purchasers. Unless otherwise explicitly stated, the provisions of the Agreement shall survive its termination. The Agreement and any disputes arising there from shall be governed by the laws of the State of California.

  16. Health and Fitness believes that there are no officially copyrighted materials on this website. However, if you do find any materials on this website that you yourself feel you have exclusive rights to, please e-mail Health and Fitness and we will be happy to remove the respective documents.
